The signalman stood accused of buying and smoking a ten-dollar bag of oregano, that he thought was marijuana.Unfortunately for the moral fiber of the Navy, McDermont had to get the slickest wheeler-dealer in the Defense Counsel's office: none other than Lt. (jg) Daniel A. Kaffee himself.First Kaffee stalled him. He made an appointment in his own office, and then didn't keep it. Lt. Spradling found him on the softball diamond, doing softball practice!He called Kaffee's name. Twice. The second time he screamed it out, so Kaffee said, Dave! You sound distraught! D__n his tricks!What followed was everything that was so annoying and nerve-wracking about talking to Kaffee. In point of fact, Kaffee didn't give a rip about drug law. The point wasn't that it was ten dollars worth of oregano. The point was McDermont thought it was marijuana and smoked it as if it were. And what did Kaffee say to that? My client's a moron. That isn't against the law. And then Kaffee said he would file a motion to dismiss. And if the MTD is denied, I'll file a motion in limine to seek an evidentiary ruling in advance. And then I'm going to file against pre-trial confinement. What could Spradling say? The whole setup had been just that: a setup, to catch the kind of person who would possess drugs and put himself under the influence while on duty. And Daniel Kaffee knew what it really was: entrapment. And then came the twist of the knife: You're going to spend the next three months going blind on paperwork because a Signalman Second Class bought and smoked a dime bag of oregano. It wasn't worth it. So Spradling tried to get the most out of this that he could. B misdemeanor; twenty days in the brig. C misdemeanor; fifteen days restricted duty, Kaffee countered.Spradling knew he had to take it. What could he do?
